As concrete information on the ‘illegal’ actions of Election Commission under Chief Election Commissioner Gyanesh Kumar, including the reports that he was acting totally ignoring the dissent recorded by the other two Election Commissioners, all the Opposition parties have now come forward demanding his immediate resignation. Earlier, when well-meaning sections and all democratic forces in the country have been opposing the SIR including its ‘logical discrepancy’ that aimed at systematically disenfranchising mainly the Muslims and youth, with the exception of Rahul Gandhi, many Opposition parties were considering the issue as an insignificant one. However, with the information that the two Election Commissioners had put their objections on record at least 14 times between October 2025 and August 2026 against the unilateral move on the part of Gyanesh Kumar, now all the Opposition and the entire country are now rising up against him and the fascist regime using Kumar.
The role of the judiciary, which could have stopped the unconstitutional and illegal SIR, is also revealing. In the beginning, even the apex Court’s proceedings regarding SIR were like a Kangaroo court, and the Supreme Court even upheld the SIR and its ‘logical discrepancy’ that ultimately led to the elimination of more than 13 crore voters from the electoral roll. Of course, the Supreme Court has now consented to go into the constitutional validity of Section 16 of the CEC Act, 2023, that grants the Chief Election Commissioner life-long immunity from civil and criminal proceedings for official acts. In fact, it was the 2023 Law that replaced the Chief Justice of India from the selection panel with a Cabinet Minister chosen by the Prime Minister, thereby enabling the fascist regime to transform the Election Commission as its most pliable fascist tool to keep the election itself as a facade. When it was challenged in the Court, the latter refused to intervene, giving the fascist regime a free hand for manipulating the elections.
When all are now targeting Gyanesh Kumar as the villain, it should be underlined that he is only a stooge of the fascist regime whose ideological-political and organisational control is with RSS, which is in its maddening pace towards a Majoritarian fascist Hindu Rashtra. Kumar has been only a tool for facilitating this heinous task. All his illegal and unconstitutional actions were as per the diktats of the fascist regime. And, its outcome is the fraudulent electoral process and targeted deletion of crores of non- BJP voters and Muslims in collusion with the street power of Sangh Parvar, leading to the ascendancy of fascist “double engine governments” in 21 States across the country.
In this context, the demand for resignation and punishment of Gyanesh Kumar and abandoning the whole SIR should not be the end, but only the beginning of a prolonged struggle against the fascist regime which has been using him as a tool. We appeal to the working and oppressed people and all democratic and progressive forces to transform the struggle against the huge electoral fraud as a launching pad for developing country-wide movements and struggles to overthrow the fascist regime itself.
